Got a ticket for failure to yield the right away. In RCW 46.61.235 crosswalk law what is meant by "upon"?

I saw a pedestrian standing on the curb at a marked crosswalk on the opposite side of the 2 lane 2 way street that I was traveling on. Posted speed limit was 25 mph. I slowed down but drove through the crosswalk without stopping...the pedestrian never left the curb. I was cited for failure to yield. Do you have to stop if the pedestrian is just standing there with out any indication of intent to step into the crosswalk and cross the street?
