They were never married. The mother has let her parents care for the child. She has hardly been involved in the childs life. My son has talked to grandparents on several occasions about his daughter coming to live with him since he has been involved in her life since the day she was born & feels that he can take this role on more responsibly than mom. He is a full time student & will be starting a work study so that he will have more time with his daugher.I am helping w/finances. He has found out things (has on tape) about mom including her admitting to being on meth for over 3 1//2 yrs.She did not live in the home with child for 2 to 2 1/2 yrs.We have been told if he takes mom to court for custody that grandparents can get involved and seek custody because the child live in their home.
She was only living their because mom was given custody & let them raise her.I've been told since she has been in their home more than 6 months they could sue for custody.If he can prove mom unfit is there a chance that he will have to fight grandparents too or if he can prove that his daughter w/b in a stable,loving enviroment do the grandparents have any rights. I had an attorney tell me that the grandparents could go for custody.Everything I have read tells me the parent would have right before the grandparents. My son had a few minor scrapes with the law when he was young but has been out of trouble for several years.The attorney tells me this will hurt & the fact that he is going to school & not working will hurt. She tells me b/c his daughter has lived in the house w/ the grandparents for 5 years, this will hurt case.So he should suffer b/c the mother, who was suppose to be raising their daugther chose not to & let the grandparents. This was not my son's doing.I do not understand. Save
