Technically, the tenant needs to give you a 30-day notice to terminate a month-to-month tenancy. You are free to waive this 30-day notice requirement, if you wish to do so. Under California law, landlord must refund security deposit (or the balance of security deposit) within 20 days of tenant vacating, and provide tenant an itemized statement for any portion of deposit kept. You should refund back to the tenant and not to third parties, unless tenant instructed you in writing to do differently. You should consult your own attorney to protect your legal rights. |
