I am a student doing clinical rotations at a hospital in Florida. While preparing the room for a procedure, a nurse physically pushed me out of the room. I have filed a complaint with my "employer", but was not sure where to go from here. What should I do?
Hold on a second! You are or will be a doctor...a medical professional. As a professional, especially an emotionally mature one, I think you are obligated to take a second to reflect on whether her conduct was justified in any possible way that perhaps you are not aware of. Only you can objectively determine whether it was your ego that was bruised in this confrontation with a seeming subordinate, or whether she overstepped her boundaries in attempting to help a situation. In either case, you may decide to take the "high road" by NOT filing a police report, not suing her for a civil assault or battery, not sending her a lawyer's letter, etc. If you do, you will be perceived in a negative light by your superiors, instructors, administrators, co-workers, and they will isolate you. Speak calmly with the supervisor about how her behavior was totally inappropriate and unjustified no matter how much she felt she was justified. Tell them that you are not the type to file complaints, call police, see lawyers, etc., but that having such an employee nurse pushing others is a liability to her employer, i.e. the next one she pushes might not be as forgiving as you. The employer should appreciate your action in keeping this in-house, and she will receive a notation in her personnel file. Don't you think this is a better outcome?
Were you injured? If so, you are likely covered under your employer's workers comp policy, and they should send you for medical treatment. If you were not injured, I would tend to agree with Mr. Shapiro, and say that you should "take the high road." Technically, you would have a criminal case for battery. However, do you really want to be that person who tries to file criminal charges for a push? This seems like something that should be handled by Human Resources.
You may want to consider criminal charges. You should have a FL attorney talk to you about whether you have enough damages to pursue a case. Hopefully your employer will step in and take care of it.
