If your father is alive, he is entitled to the 401(k) account.

Please note that I am answering this question as a service through Avvo but not as your attorney and no attorney-client relationship is established by this posting. An attorney-client relationship can only be established through signing a Fee Agreement and paying the necessary advanced fees.

No, your father is still entitled to his account. He could see if he has the opportunity to cash out the plan and give it to your mother.

No. It is his property.
