Changing employer during visa processing.

I am currently on a L1B visa, and have been for 3 years. This year my attorney is recommending I transfer to a H1B visa. If my petition is granted, can I change employer before October prior collecting my H1B visa in my passport? Do I need to physically have the H1B visa in my passport prior to looking for a new employer?

    Answered January 16, 2013 16:08. Visa is for travel, it is not proof of your status. Regarding changing employers, I strongly recommend not to file multiple petitions simultaneously as they can create confusion especially if they are filed as change of status petitions seeking a particular date when the status automatically changes. Speak to a competent immigration attorney to discuss your options.

    Answered January 15, 2013 21:55. Do you have a potential employer in mind ... or are you just exploring your options?

    Simply put, it is never a good idea to change employers while papers are 'in the works'.

    Other questions would be best discussed in private, with a different lawyer than the one that works for your employer.
