Can immigration add charges to your case from the pasted?

my bf was arrested for traffic tickets and was held in prison for about 10 days and ice picked him up this is his second time going to immigration. the first time he got arrested for domestic violence but they didnt add those charges so they let him stay so now they are adding those charges that happen in the past can they do that?
