My son had not been paid any of his commissions (nor had most of the others working for this contractor), so about a month ago he stopped working for him. The contractor says he cannot pay people until he (the contractor) is paid by the telecommunications company.  What is the best recourse for my son to get the money he earned?  And, how can I determine if this is some sort of a scam?</description>

      <description>I'm a salesperson that worked for a large telecommunications carrier. I had a written sales compensation agreement with them. My commissions were to be based upon my results vs. an established quota. During my employment I received an injury (not work related) that required extensive surgeries and that put me out on short term disability for almost a year. When I returned to work it was July. I was given a revised annual quota which was adjusted based upon the time remaining in the year. In Nov I was able to close a very large sale that put me well over my quota. AFTER I made the sale, my Sales Director doubled my quota, took half of my sale's revenue and spread it across the reps of another under performing sales team, and gave 25% of my sale's revenue to another salesperson on my team.</description>

I have been using it for 15 years.
Regrettably did not file for a trademark earlier.

PROBLEM:
There is now an existing single category mark with the USPTO.
Incontestable.

Can I still file for my mark in the same geographical area,
New application?

Both business have the same but are somewhat different.
I started my business first.
I maintain computer systems, they write programs.

Would different services be different enough? 

What might happen if the mark is denied, will I be sued for using the mark based on denial, will the USPTO tell me to stop using it. Should I not file for a trademark</description>

      <title>A bankrupt former employer's debt has appeared as a charge-off on my credit report-my credit damaged for $128!!</title>

      <description>I was required by my former employer to have a corporate phone line installed in my home.  It was stricly for business use, as I already had a residential line set up in my name for personal use.  
When I was laid off/business shut down last October, I called to close the account and Verizon told me I wasn't authorized, so I just unplugged the phone.  They kept sending the bills to the corporate address and allowed charges to accumulate for months.
Then in March a collection agency started calling me at home re: the unpaid bills.  I referred them to the banruptcy attorney and explained the debt wasn't mine.
I recently checked my credit score and it went down 30 points for a $128 charge-off.  
I have no other late payments or charge-offs-this has damaged my credit-how can I resolve?</description>

      <description>I have been told on many occasions that US Code Title 47, 415 limits the statute of limitations on all telecommunications related debts (telephone, cell phone, radio, etc) to two years.  In fact, part (a) of this section reads as follows:

(a)  Recovery of charges by carrier
All actions at law by carriers for recovery of their lawful charges, or any part thereof, shall be begun within two years from the time the cause of action accrues, and not after. 

Is it really true that this law limits the statute of limitations on this debt to two years.  If so, does this make it illegal for a collection agency to attempt to sue for this debt?</description>

      <description>I have started a web site where people can rate others on their their personality as well as other personal characteristics and attributes on a scale of 1 through 10 and also can provide comments as to why they gave that rating. The site is very specific as to who is being rated. 

If visitors to the site use this to attack the character of others with false and possibly harmful statements or allegations, can I be sued for defamation/libel for providing a platform for these allegations to be made even if the user agreed to a disclaimer and terms of use that prohibit them from making such statements and resolving me of any liability of they do violate the terms of use?

      <description>I got a dui in jan of 09. this was in downtown la. by LAPD. i am currently on summary probation. 1 month ago i while driving home from work i encountered a dui/id check road block.... this was in the city of hawthorne, and i was ticketed by the hawthorne pd. my license was still suspended from the dui. my car was impounded... since this event, i have obtained a restricted license, completed the 3 month alcohol program, got my car back from the impound and i am current working on finishing my cal trans. what are some possible outcomes of this event? (violation of summary probation). since i was ticketed by another pd, does this mean violation of probation may go by unnoticed? thanks-</description>
