I have tried to settle through their attorney, who made an oral agreement to settle in September and when he found out I was employed with the Federal Gov't and made a good salary he refuses to work with me stating I make more than him. I just received service for the Write of Garnishment after 8 months and filed a Claim of Exemption and Motion to Dismiss the Judgement and the attorney just sent me Request for Production of Documents asking for my 2008 IRS returns and my 2009 earning and leave statements. I want to ask the Court to limit discovery to the time of the indebtedness. I was indigent and homeless at the time due to Katrina. I traded in a 2002 maxima that I owed 12,000. The dealer told me he was going to pay off my trade. I know better now but, I did not realize at the time that it was going to be done by adding the money to the cost of the loan on the new car. I most likely signed something consenting to the amount of the loan. I the contacted the bank and they asked me some questions. It was then that I discovered that the sales guy lied to the bank, and that the bank would have never made the loan otherwise.. He told them I made twice as much, that I had been employed twice as long, and told them I was a veteran of the navy to get the Navy credit union to buy my loan. The bank told me to stop paying. 2 years no payment no repo. What do i do?
