Would the current pension position, being approximately 50% accumulated, be considered a marital asset?  Am I entitled to half of the current position or approximately 25% of the full pension in 15 years?</description>

In the real world, would a collector try to garnish assets from the &amp;quot;good&amp;quot; spouse for the &amp;quot;bad&amp;quot; spouse's debts?  Hve $100K debt of which $22K is IRS.  Don't want to file bankrupcy.</description>

I had to sell rental property to cash her out on her half of community property,even though it had been purchased before the marriage. She has since moved back in with me &amp;amp; our child &amp;amp; wants to get remarried but all her money is gone &amp;amp; she has much bad debt. I do have a mortgage on the primary home &amp;amp; it is completely in my name. I do not want liens put against home or go through another spit up of community property &amp;amp; lose primary home. she was all for a pre-nup until we actually sat down with attorney to get it done,then she refused to sign.</description>
