      <description>Can someone who is out of status but qualify for LIFE act start working for the company that would file for his sponsorship prior to labor certification approval?
My friend has good credentials, BS/MS in Computer/Software Engineering from  reputable universities, 10+yrs of related workd experience and a patent pending. There are top IT companies willing to sponsor but not wait for 9-12 months to get work authorization card. Is he eligible to work while the labor certification is pending? what are the options? 
How soon can he start if the company is ready to file for his green card via labor certification process?

My H1 visa,I-94 expires on Feb 2010.My Employer would be starting the renewal process in a week or two.

I&amp;quot;m planning to send my wife,son to india on Jan 2010.They will planning to return once I get my New petition. 

1) Can they allow to leave US when extn is in progress?

2) Can I go back after i got my approved petiion and get it stamped the Visa?

3) Generally what is the Min and Max period for getting the Renewed Approved petition for H1?

      <description>I'm a us Cuban resident , I was stopped by an immigration officer coming out from a cruise . They arrest me because when they checked my background I had a felony (stolen car) .  That time the judge gave me 2 years of probation, I did those two years and I thougth everything was ok with my immigration status. I went to court  
, the judge let me go with 1600 bond cause he understood there was no reason to deport me. After that , the goverment prosecutor appealed the case , sent  it to Virginia and now im waiting for an answer from them.

      <description>Hi, my dad is a resident alien for over 30 years now and was just given a misdeameanor and a felony. one is carrying a pistol while intoxicated and second for carrying pistol without a permit. the prosecutor has offered my dad probation for 2 yrs - he's looking to accept this the 30th which is his next court date. Besides this there are no other arrests ever made, except a dui in 13 yrs ago.

His green card should expire soon (2-3 yrs) could this conviction get him deported? also, the prosecutor would also change the felony to carrying a dangerous weapon, instead of a carrying a firearm if he accepts the probation deal that was offered.
