This Attorney specializes in estate planning. It has come to our attention that he has has been having an ongoing relationship with individual and hired her to care for an elderly gentleman in a nursing home. While the elderly gentleman's estate was in the care of this Attorney, it has come to our attention that this person was paid $23,000 from his estate to stop by and look in on him weekly. Needless to say, this person was falsifying their time record and the Attorney was complicit because of his relationship. In June, this person was arrested for shoplifting, improper use of a firearm and possession of Illegal substanses. By the relationship has continuted. Should this Attorney be investivated by the State BAR for ethics?

In response to a complaint against a law firm, the State Bar has denied furher study, and adds request may be filed to reopen the complaint. Up to now it's getting difficult in pursuit of filing it, as it requires time researching and preparing.

Is there a way for help from a counsel, such as writing it, and finding and adding new evidence? Or where do you get a direction on this? Also, is there a time period in filing a request? How long may a request be?

What action if any, is an attorney required to do if he becomes aware that a party to a malicious law suit has been determined vexatious with his filings on several occasions prior, including being noted as vexatious in an Appellate Court ruling? What if this attorney pursues and encourages civil litigation against this individual even after being aware of this information and refuses to convey his findings with the Court or the opposing attorney? -

"Utilizing rule 8.4 and 8.3 to entice litigation" (Arkansas)

When the defendant’s attorney became aware the plaintiff’s attorney clearly violated rule 8.4, he then used that information to instigate a counter claim. (asking his client to pay him monthly to author it) His client then had a change of heart after learning an additional $65,000 was required. Now, this attorney is downplaying the actions of the plaintiff’s attorney, even after being reminded of rule 8.3. Further, this attorney will not ask for a summary judgment until he is paid the balance of $5,000 owed for authoring his counterclaim. Recent testimony clearly disputes the original claim, and a summary judgment would dismiss it. I'm named as a defendant on the original claim and they are actively still trying to serve me. Any advice?

Deceased has been dead for 11 years & the lawyer handling it is also in the will. He keeps giving us excuses...

The lawyer is related to the deceased and he is the executor as well. Over the last 2 years he has told us time and time again that the estate was about to close. The latest letter was in August 09 stating that the tax return would be completed very soon and that the disbursement letter would be sent by Sept 09. We have yet to receive that letter. When I called the lawyer, his assistant said that they are now waiting on stocks to be cashed. BUT, they told us that same thing last summer (2008). We don't know where to go from here. We are thinking of filing a grievance against him w/ the WA State Bar, but we want to have all of our ducks in a row before we do something serious.

Thank you very much
