How do I go about filing a copyright infringement civil suit?

So long story short - images of myself, another person, my website along with video of other person were posted without our permission or approval. They are unwilling to remove them and since I've attempted a DMCA notice and they just reposted them with the ISP in question not taking any actions after that, I'm left with going after them in court to get those images removed. So, since I have no money to pay for a lawyer (and yes I know of the risks of doing this on my own), I would like information on how to file a civil lawsuit since I have no clue how to even begin this process any help would be appreciated :)

Copyright on short/long sayings, what is a short sayings? And a long one?

Hi,

I've been answered, quite fully to another question about quotes and copyright, for that, thank you!

It's now almost clear to me, but someone stree the point of "short" and "long" quotes. I

"A "saying" IS copyrightable if it's long enough to pass the "modicum of creativity" test."

"if they’re short you’re free to publish them w/o permission from the author. But if long, you need to investigate who created the work and when it was published."

"A leader is best when people barely know he exists, not so good when people obey and acclaim him, worst when they despise him. But of a good leader, who talks little, when his work is done, his aim fulfilled, they will say, 'We did this ourselves.' "

Is this a long sayings?

Thank you!

Kind regards,
Nicolas

intellectual property law

I own a small business in NY state. One of my employees has left my company to go work for my competitor. Are there any intellectual property laws that protect me as an employer from my past employee blabbing about my trade secrets to my competitor?

I appreciate your response.

Some company is in possession of my intellectual property and is attempting to use it. What should I do?

I'm a self-employed software developer. Recently, some company approached me, wanting to use the software component I created earlier, in exchange for a fee.

I agreed. They sent me freelance contract which I signed and faxed. At the same time, I sent them the source code of the component. Once they got into possession of the source code, they stopped communicating and never sent me back the contract with their signatures.

I know that they are attempting to use my code for their product.

What can I do to prevent them from using my intellectual property?

Question about applying for copyright??

I'm wondering about the copyright process. How much it would cost to get a copyright on a design? I have one overall concept that can be described, but there are a number of variations. Each separate design follows the same theme and concept, but is a distinctive design itself. I'm wondering if one application can explain /describe the overall theme/concept and simply show each design (8-10 total designs?. Or would each design need a copyright for itself?

Obviously, the cheapest way to protect the overall concept and it's *8-10* individual designs would be best.

Thanks.
