      <title>Did not get full disclosure on monthly HOA when I offer the contract.</title>

      <description>I'm currently under escrow and estimate to close on 12/03/09. Couple days ago, I found out that the $345 monthly HOA included a $60 Special Assessment, which expires Dec 2011. This Special Assessment began back to Dec 2006 when the developer was sued for some construction problem and the short fall settlement fee was levied to each unit. The owner of the property I offered decided to pay this fee monthly for 60 months instead of pay upfront the fee. This is a short-sale and I refused to take over this Special Assessement since it happened back to 2006 when I wasn't even there. My agent said that I agree to the $345 HOA when I submited the offer. When I submitted the offer, I assumed the $345 is a regular assessment. My agent shoud research/inform of these disclosures. Am I wrong in this?</description>

      <title>Failed Septic System</title>

      <description>We purchased our newly constructed home in Feb. 2004.  Our septic system has failed as of Aug. 2009.   Upon inspection by the Town, County, &amp;amp; Independent contractor, our system was not installed according to the approved plans.  The Engineer who designed the plans for the system signed off stating &amp;quot;To the best of my knowledge, the system was installed according to approved plans.&amp;quot;  
We have a 6 year structural warranty with our home which will be up in Feb. 2010.  The developer that built our house has since changed the name of his company and is now building under a different name.  

Is it worth it to pursue legal action against the developer?  Our estimated repairs for the system are anywhere between $10-20K.</description>

      <description>I signed a contract for a condo unit preconstruction back in 2005.  There were significant delays on the developer's side in completing the building.  They have finally indicated the building is complete and that they are ready to beging closing on the units, however I no longer which to purchase the unit.  Is there an argument I can make the contract should be nullified due to the length of time that has passed.  The contract did not contain an estimated closing date.</description>

      <description>We hired a contractor and have paid all cash thus far.  All that remains is the 3% Retention and disputes of about $5,000.00.  However, the contractor has failed to complete the Punch List and not addressed other items that should result in a reduction in the final amount owed.  We have provided the Contractor with the specific issues and photographic evidence.  We have requested he adjust the final billing, but as yet he claims we have failed to respond and notified us of his intent to file a lien and proceed to foreclosure.  Any advice other than hire an attorney?  Thank you.</description>

      <description>I submitted the above heading regarding a copyright case. I did receive two candid responses, was very appreciative of the attorneys opinions, and learned a lot. Fortunately I have had to pursue only one other large business case in my life as well as a few 'Small Claims' cases. (Cost of doing business). Since I only go to court when I have to, I have never lost a case. In response to one attorneys comments where few attorneys will take my case seriously and many will choose not to become involved with the case.  This is so true. Thank God I did not give up on my large 'Breach of Contract' case. After twelve law firms stated that I did not have a case, I finally found a lawyer who saw it as I did. 30 minutes into the deposition we won the case. If the truth is on your side NEVER GIVE UP!!!</description>
