I lost my job a month ago. The only income I have is the unemployment check which is $200.00 per week. I have spoke several times with my lawyer but he is refusing to readjust to the weekly income I am now receiving. His secretary tells me the only thing he can do is for me to give over my car, then he will readjust the weekly payments. He is refusing the readjust my payments after I have requested for a payment change.

Can I reaffirm my mortgage after a chapter 7 discharge, even if the mtg was included in the ch 7?

We live in Maine and filed for ch 13 in Jan 09. We had a subprime mtg with wilshire credit corp. we applied for a modification and waited months with no word. We finally decided to convert to a ch 7 because the lender and the courts expected us to pay our current sub prime mtg pmt plus the monthly payments to the trustee for our ch 13. We couldnt make it work because I was out of work. We received our ch 7 discharge in Aug 09. We still wanted to keep our home but felt like we had no choice but to give it up at the time. Our situaution has improved and I contacted Wilshire and they said they would consider a modification after I submit the financial info to them. Am I legally allowed to reaffirm even though this mortgage was included in the ch 7? What are my risks?

Illinois, we got ourself wrapped up into a severly HIGH interest rate loan, it has SHOT our credit because of inability to pay

I want to know our best way out of this. My husbands business is failing and we are in over our head. Our late payments to this loan plus what we pay monthly are screwing us financially. We have 5 years left to repay because we tried refinancing to lower our interest rate but its not helping. Is there ANY way out of this or are we just screwed? Our debt is not enough to file bankruptcy but we are just falling way behind every month because of this loan. Is there any way out of this? If we just stop paying, whats the worse that will happen, we will get sued and still be unable to pay? Our credit is shot regardless, any advice would GREATLY be appreciated,
