attorney quit the case, Do I need to see a judge to keep this lawsuit alive before it is dismissed, and what is the process?

We paid the attorney $10,000. to sue defendants. It is now one year and two months later and atty, has not served the defendants. He has used all $10,000 and wants more. He is late in filing deadlines, promises much and does very little. He wants out (unless he gets more money) we have no confidence to continue with him.
Is there any way I can sue him in small claims court for the money back? Is there any complaint procedure.

Verizon not honoring online service and equipment order, even though order went through confirmation.

I ordered 5 verizon phones through the verizon website -- 1 smartphone and 4 "regular" phones. I placed the smartphone on a basic plan but added texts ($80 total). I placed the other 4 phones on a family share plan with 1400 minutes and texting. When I placed the family plan in my "cart," the plan came up at $39.96, so my total order for monthly service was $119.94. I received an order confirmation and my card was charged for the phones. (Try it.)

Verizon told me a day later that they did not have the $39.96 family plan and that I would have to change my service -- putting all 5 phones on one plan would cost $190/month. They claimed that despite being allowed to order it, they could not honor the request.

Is the equipment/service order a contract that they should honor?

Can a business change contract terms AFTER the service has been given?

I was hired as an independent contractor by an agency for October 8, 2009. I signed all the contractor forms, filled out a W9, and did the job. I just got an email YESTERDAY (11-19-09) saying that they are not recognizing me as an independent contractor due to the IRS guidelines (which I definitely fall under - I have been working as one for 12 years) and are sending me to a payroll company. I feel they are jerking me around. This company had given me a 50 day promise for payment. I should be paid by the 29th of this month. And I executed the work as an independent contractor. Is this legal for them to change the terms over a MONTH AFTER the service was given?

How do I go about filing a small claims against an attorney who over charged me and did not pay the services he hired?

I paid a retainer and was billed for my attorney to "argue" with me when I questioned what he was doing. It went down hill real fast. He went through the retainer on researching items I told him not to, then charged me beyond the retainer. I have been making payments "under protest" and found out he did not pay a service he hired when there was still money in the account and now he passed on the bill to me. I questioned him about "double billing" since the charge was added on to the bill I have been paying. I know this is not a good subject to ask an attorney but I need help. I have been played badly and do not know what to do next.

Contractor walked off job. Refused to finish and address items done incorrectly. Threatening to put lien on TX homestead

Signed a contract for granite work in kitchen, laundry, and 3 baths, but they didn't put agreed changes in contract. Wife didn't sign contract. No arbitration clause in contract. Work was shoddy--we addressed this with contractor and sales rep a number of times to no avail. Called county clerk--were advised that contractor could file lien against our homestead even though TX law says both owners of a property with a homestead exemption must sign contract. County clerk said if contractor filed fraudulent lien, we have recourse in court. We have excellent credit and don't want it ruined but we also do not want to pay this contractor.

How do i get opposing counsel to folloe through with Binding Arbitration?

In a case last week when one of the issues to be resolved (division of personal property in two states) came up, opposing counsel suggested to the Judge that the issue go to Binding Arbitration. The Judge, after hearing timing issues from me asked opposing counsel if they could accomplish it with two weeks... they said yes, and that is what the Judge ordered.
A week has gone by and no movement from their side, pressumably due to the unreasonableness of their client.
What are my remedies, against the law firm, and/or their client?
