Postnuptial Agreements

If married couples wish to determine how property, finances, or debts should be divided should they divorce, they can sign a postnuptial agreement. Unlike a prenuptial, which is prepared prior to marriage, these agreements are reached during a marriage in order to address circumstances which may have arisen since the marriage began. Common examples include provisions for a parent who chooses to stay at home to raise children or the transference of a business or property to one spouse's name to protect those assets. Postnuptial agreement attorneys can help draft postnuptial agreements to meet the needs of both spouses. Conversely, lawyers with experience with postnuptial agreements can challenge these in court should one spouse dispute the contract during a divorce.
