There are two main types of divorce: uncontested and contested. In the former, both parties agree on many of the main issues facing them in a divorce, such as how to provide property and assets, and how to divide childcare and support; uncontested divorces do not go to court and are comparatively quick and easy. However, in a contested divorce, the divorcing parties have significant disagreements about one or more issues relating to property division and/or childcare. Some of these cases end up in mediation, while others are heard in the courts. In either situation, contested divorce attorneys represent their clients during these contentious disputes, arguing for the best interests of their client. Lawyers with experience in contested divorces will be familiar with the mediation or trial process and aggressively fight on their clients' behalf.
