Remanded
Represented a Veteran before the US Court of Appeals for Veteran Claims, due to his skin cancer in multiple sites from radiation exposure while in the Army. The Department of Veteran Affairs had previously reduced his benefits (after initially awarding them) due to an examination several years after his exposure. He was denied re-evaluation of these benefits on appeal, because the VA appeals board claimed his appellant paper work was not filed within the time limits set by the VA. In pre-trial negotiations with the attorney representing the VA, he agreed the appellant paper work should have been considered timely and the examination used to reduce the Veteran's benefits needed to be re-evaluated. Therefore, the case was remanded by the US Court of Appeals for Veteran Claims for readjudication by the VA.
