In the largest federal death penalty case in U.S. history brought by the United States against the infamous Aryan Brotherhood prison gang, the defense team for Gary Joe Littrell successfully convinced the court that the application of the death penalty as against Mr. Littrell was arbitrary and a violation of the due process clause of the Fifth Amendment and the Eighth Amendment prohibition against arbitrary and capricious penalties. The death penalty being stricken, the United States dismissed not only the case against Mr. Littrell but also several other defendants who were also facing the death penalty.
