20 Minute Not Guilty Verdict
On November 4, 2008, a jury returned a 20 minute not guilty verdict on behalf of my client in a DUI trial that took place in Benton County, Washington. This was a tremendous result given the fact that the State offered a .16 blood test result into evidence and it was admitted before the jury. The issue in the case was the result of the blood test and how it was determined. I was able to prove that the analyst who analyzed the blood violated the protocols established by the State Toxicologist and this violation would have required the analyst to retest the blood. Ultimately, the analyst testified that she didn't retest the blood samples because she did not want to waste the time and the paper. After the trial I was able to speak to the jurors and they were mortified that an analyst for the Washington State Toxicology Lab would be so cavalier when a person's liberty was at stake.
