My client had driven off the road, over an "in memory of" DUI road sign, and crashed into a telephone pole. After investigation, my client gave a breath test well above .15. At motions, the judge dismissed this case after I argued that the officer, who smelled alcohol on my client's breath after the accident did not possess probable cause to arrest my client.
