Plaintiff sued for wrongful termination based on age discrimination. Defendant sought and obtained binding arbitration but refused to proceed with arbitration on grounds arbitrator was biased in refusing to continue arbitration. Trial court affirmed judgment for Plaintiff and Court of Appeal, in published opinion, found no justification for continuance or defendant's refusal to participate in arbitration.
