Rebecca de Vente et. al. v. Hannelore Flora

This is a case of first impression which is currently pending in the Georgia Court of Appeals on direct appeal from the Henry County Superior Court. The issue to be addressed for the first time in Georgia is whether the term “surviving child” pursuant to the wrongful death statute applies to a child who was in gestation but not yet born at the time of the decedent’s death.
