People v. Kennedy Lindsey

Client charged with DUI. He was involved in an auto accident and blew a .19 on a portable breath testing device at the scene of the accident. He later took two breath tests at the jail with registered a .22/.22 Breath Alcohol Concentration. At trial I used the maintenance logs of the breath testing device at the jail to show the jury the machine had been taken out of service about a week after my client's test and parts of the machine were replaced. Additionally the citation which was completed in the case indicated that my client had blond hair and blue eyes while my client was a dark skinned man with dark hair and brown eyes. I used this to successfully challenge the officer credibility.
