Hung Jury and dismissal of DUI
This case involved a driver who was observed swerving out of her lane and pulling up on the curb when stopped by police. The driver refused to take a blood or breath test when arrested for DUI. The officer testifeid that the driver smelled like alcohol, had bloodshot and wattery eyes, a flushed fact, slurred speach and was unsteady on her feet. The jury deliberated for two days before they decided that they could not come to a decision. The DA dismissed the DUI.
