Acquittal on 3rd DUI (.32 BAC)
Client is charged with his 3rd DUI. Police Officer states in report, and testifies at trial, that he saw client drive, crash into a parked car, and then slouch over on the steering wheel with a bottle of Hennessy in his lap. Client's defense is that he was not driving, but only drinking in the driver's seat of a parked car. Client does not testify. Mr. Flores points to lack of proper accident reconstruction and documentation to discredit the officer's testimony and show that there was no driving and no accident. Mr. Flores uses the prosecution's own toxicology expert to show that client was so drunk that he was in a near coma. Thus, he was really too drunk to drive drunk, and definitely too drunk to parallel park the car in the location where it was found. After a week-long trial, the jury returns a Not Guilty verdict and client is acquitted!
