DP v. Builders FirstSource

Plaintiff was run off the road by a tractor-trailer operated by defendant. Defendant's vehicle was a wide-load, and the evidence indicated a lack of training on the part of its driver for such loads. Driver had also received numerous warnings for past safety violations.

Suit was filed after no significant offer was made by defendant, but settled shortly before trial for the amount of plaintiff's initial demand.
