Case Dismissed

Defended a repair station in a FAA Civil Penalty action. FAA alleged that certain alterations were major, when the repair station had treated them as minor. The repair station was able to demonstrate from its own records that the alterations were minor. The matter was dismissed on summary judgment (an insignificant portion of the case remained for trial but the FAA withdrew its complaint, accepting dismissal with prejudice of the remaining charges). Client was awarded EAJA attorneys' fees reimbursement from FAA.
