Plaintiff

Toni Davis

Richard Kopelman
Avvo Rating: 7.6 (Very Good)

Jury awarded $1.15 million dollars

Plaintiff slipped and fell as she approached the bottom of an outdoor stairway on the hospital grounds, resulting in a fractured ankle and a low back injury. Plaintiff contended that the hospital failed to properly maintain or otherwise clean the stairs. As a result, the stairs became dangerously slick after it rained, and this caused Plaintiff's fall. The hospital denied fault and refused to make any settlement offers in response to Plaintiff's pre-suit offer to settle for $300,000.00. Following a week long trial, a jury awarded Plaintiff $1,148,078.10, nearly $50,000.00 more than the limits of the hospital's insurance policy.
