$480,000 verdict in Davidson County
Emma King went into the Brian Center of Lexington for rehab on her knee. Within a few weeks, they stopped the rehab. The staff would drop off the food tray and not take the time to feed Emma. As a result, Emma lost 10% of her body weight during the first month she was there. Within a few more weeks, Emma developed a bed sore. The nursing staff did not treat the wound properly. The wound grew larger than a soccer ball, and became infected. Emma had to be rushed to the hospital where the ER doctors were shocked. After months of treatment and rehab, Emma was finally allowed to go home to her family. The Brian Center denied responsibility and fought for two years. At mediation, they only offered $38,000. During the trial of the case, the nursing home hired two defense lawyers to try and fight the family. By the end of the trial, they knew that they had been beat. While the jury was out, the nursing home finally offered $350,000 to settle. However, Emma and her family were so mad that they did not want to settle. They did not care about the money, they wanted a verdict. The jury came back with a $480,000 verdict.
