  1. I received my third dwi and it has been 6 months and the DA has yet to file my case. Is this normal for it to take this long.

    If a doctor has a hint of a suspicion that you are engaging in drug-seeking behavior, they will follow up on their suspicions. They are not doing that to demean or embarrass you. If you do not like the way a doctor is speaking to you, I would suggest finding a new doctor. Defamation cases are difficult to prove.     If you have a stalking concern, you can request an order of protection from the court. But yes, it is legal for Greene County to post your mugshot and address online. Arrest information is public information.

    Contact your attorney from the state in which you are on probation and follow that attorney's advice. Also make sure to hire an attorney right away is the state in which you were just arrested.

    You certainly have a chance. What you need to do is consult with a personal injury attorney right away and not make any statements to the insurance company. If your case goes to trial, a jury will determine fault. While you are correct in saying that it is not illegal to use a cell phone while driving, the fact that the other driver admitted to using a cell phone while driving is a fact that will work in your favor.

    It means that you won't be considered a "prior offender" under RSMo 577.023, which is a good thing for you. You still need to get a lawyer immediately to minimize the consequences that you will face.
