    Asker - you keep asking lots of hypothetical questions about things happening to other people that are ALWAYS outside the statute of limitations. I for one do not believe any of these things ever happened. You need to stop obsessing over the past, both yours and other peoples.

    There's a couple of things wrong in your statement - in smc the da doesn't say how much time he will serve (the judge does), he clearly has a record (or you don't get to 6 years), and this case has been going in for a while ( if he's at the pre trial stage) which means he has an attorney. You really need to talk with him/her about the case.

    In SMC, if you've had your arraignment and didn't hire an attorney, then you have a private defender. Speak with him/her. Felony DUI cases in SMC are not eligible for pre-preliminary hearing dispositions, so you will have to go thru your PH first in order to get any kind of deal. If your DUI is a felony, then you either had 3 prior DUI's (or one prior felony DUI), or you hurt someone. They take felony DUI's very seriously in SMC, and usually don't plea them out for anything less than some...

    Your question makes no sense. There is no such thing as a litigation privilege. There is attorney-client and work product but that's it. Neither of them fit into your scenario. Please repost with clearer information.

    Yes. Everyone, regardless of immigration status, is informed that their plea may result in deportation, exclusion from the United States, or denial of naturalization services (not in that specific language always, but some form of it). It's a standard admonition that doesn't care about race, gender, national origin, or immigration status. It is read to everyone prior to entry of a plea.

    First, you gave the officers permision, so you effectively consented to the search of your home - shame on you, especially if you've done this 6-7 times. That said, unless if was a really big drawer (i.e. big enough to hide a person in), the officers may have violated the implied terms of your consent - namely, limited consent to search for a person, not search for anything and everything.     In my experience, if the case is still under investigation, but charges have not yet been filed, you can't get a copy. Once charges are filed you may be able to get a copy from either the police department or the DA, but it will most likely be a redacted copy, and you may only get the portion of the report that pertains to your statement, as the police/DA won't want you seeing what other witnesses have said or what other evidence was found for fear it may change your statement/testimony in the...
