  • IF YOUR ATTORNEY DOES NOT SHOW UP TO DEFEND YOU BECAUSE HE COULD NOT GET ANOTHER CONTINUANCE IS IT CLIENT ABANDONMENT ?

MY CASE IS A PUBLIC DEFENDER CASE , i AM BEING RETRIED 2ND TIME , ATTY HAS A PRIVATE CLIENT $ $ $ $ AND THEIR TRIAL IS SET TO BEGIN AT SAME TIME . HE WAS ALLOWED TO SET TRIAL DATE A MONTH AND A HALF AGO PER HIS CALENDAR FOR MY TRIAL . JUDG...

    Chris’s Answer

You clearly don't have a public defender-pds can't take private cases. You may have a conflicts attorney, which is a private attorney in many regards. Your case can be continued because of another trial by that attorney for lots of reasons and under lots of circumstances. If you are dissatisfied with your attorney, request a marsden hearing or hire a private attorney.

No - if the police weren't called, then nothing criminal is likely to happen. You will get a notice in the mail from attorneys for Wal Mart saying you owe them lots of money - that is a civil demand that you are under no obligation to pay, and I advise my clients to ignore it. You got away with it this time - don't do it again.

    Chris’s Answer

No police department that I know of has the time or resources to go after someone for shoplifting unless that person is caught at the store. I doubt any detective would waste his/her time on you or your friend, no offence.

  • Do i need an attorney and am i going to be found guilty

I was suspected for petty theft . I was cop orating with the police about everything and In going to have a lesser charge or am i going to be found not guilty

    Chris’s Answer

    1) Stop cooperating with the police - that never does anyone any good and often just gets you in more trouble.
    2) Get an attorney to review the facts and can give you a detailed opinion. Most attorneys here (myself included) offer free consultations.

You can probably get it infracted and dismissed, depending on the specific charges. There is no such thing as "expungement" in California, so your options are limited. Talk to some attorneys who, like myself, post regularly on Avvo, offer free consultations, and practice in your area.

    Chris’s Answer

You will recieve paperwork in the mail from the probation department. They will set up an interview with you. You should have your parents hire you an attorney by then, preferable someone (such as myself) who knows San Mateo County. You will also recieve a letter in the mail from Kohls saying you owe them a lot of money. That is a civil demand, you don't have to pay that, so just ignore it - it wont have any effect on your criminal case.
