Do I have any recourse for buying a home that was supposed to be on Sewer but turns out it is on Septic and I had to repair it?: I purchased the home 7 and a half years ago with "Sewer In And Connected" in the paperwork. 3 weeks ago, my septic tank overflowed on my front lawn. I hired a company to pump the tank and discovered it had not been cleaned out in more than 35 years. The leech lines were under the driveway and have been crushed from heavy trucks driving over it through the years. The leech lines were filled with muck and had to be completely ripped out and replaced. There were no tank lids exposed, and I would not have had heavy trucks driving over my driveway if I had known I had a septic tank. Also, isn't a house worth more with Sewer in and Connected than if it is on a septic tank? I have reason to believe that the previous owners were aware of the tank but did not disclose it to me
Deborah's answer: Was this intentional fraud? If so the statute of limitations to file a suit starts to run from the date of discovery, not the date of the contract and disclosure. Most purchase agreements have a mediation clause and if both parties initialed the binding arbitration clause, you must engage in private aribtration rather than a court trial. My son was in a car accident. He was not at fault.: There were three vehicles involved. The first car ran a red light and ran into a truck. That truck hit my son's truck. Luckily, no one was injured. Who is responsible for the damages? The driver that hit my son says his insurance is not liable. The driver at fault was not insured. Now what should he do?
Deborah's answer: The driver of the truck that was pushed into your truck is not off the hook. Even though the car that ran the red light caused the accident, the insurance for the truck that hit your son's truck may still provide coverage. If your son's vehicle insurance has uninsured coverage or underinsured coverage, that insurance would also be available. I suggest your son consult with a property damage attorney or check with his own insurance company for uninsured coverage that may be available.
I want to use 30 seconds of a track from a DJ at the beginning and end of my video blog interviews. Do I need to pay him?: No more than 30 seconds. 10-12 seconds at the beginning and 15 seconds during the end credits. The site is not currently making any money.
Deborah's answer: If the DJ track is comprised of songs that are published by an artist you would also need a mechanical license on those songs which you can obtain from Harry Fox Agency on line. I suggest you consult with an entertainment law attorney before you record your video.
