Can I get my son back ?: Last year I was going thru a rough time at that time I was homeless and I agree to let my son's father mother take my son temporary for 6 months we never went to court it was basically a piece a paper that saying I gave her guardianship and we went to a notary office got it notarize i lost the paper we did but I know she has it and since she won't return my calls can't talk to my son she cut me off for nothing now its 2019 and its getting worse what should I do
Debra’s answer: You should contact an experienced family law/guardianship attorney immediately. This could be a complex situation and you need to know if there was ever a guardianship proceeding. Your rights and remedies depend on the status of the paperwork and other factors that an attorney can discuss with you in detail after learning more facts.
Question about how to complete a CA FL-350, both parties agree?:
Do we have to fill out our disposable income on question 1?
We have two children, but the form allows space for one child, can I put both names there or do I need one for each child?
Debra’s answer: There are two lines on the Court form. Or you can say "see attached" and list the amounts. If you use the online form it is easier for the Court to read. You have to put your income on line 1 or attach the child support calculation. You should use the child support calculation because the Court needs to have that information. See if your Court has a Self-Help Center to help you.
Medical expenses for kids after divorce?: I got divorced about 3 months ago and have 2 kids. My ex has a stable job and also I am getting my spousal support plus child support. (We both have enough money) My older son is 12 and he has a bite issue and I was going to fix that last year and my ex said he has no money. One of his upper teeth started to wear off almost half way due to his bite issue. He made me wait till 2019 and now he is not willing to pay half of the cost. He tells me either I have to take him to cheap places (SMD, they don’t work with dentist or orthodontist) or he won’t pay. Even if I take him to place he wants, he says he can only pitch in certain amount! (Which I won’t because it’s not an pediatric orthodontist) And my son wants the braces now, before he starts high school. I ask my ex if he is not happy with the orthodontist he can find another one but he is stubborn about not to take him real orthodontist! His only issue is money not my sons health. my sons first treatment will be end of this month! What should I do legally to protect my rights? If I pay fully at the beginning can I make him pay me the half later legally? He is okay with the place if I pay only! and didn’t join any of the appointments
Debra’s answer: You should look at your Judgment and any other orders carefully to see what they say about uninsured expenses and if they are listed. You should have an experience attorney look at the documents to give you advice. You can also file a motion with the court to see if they will order that this is an expense that must be shared.
