Michael’s answer: Highly contested area of law. Meaning the neighbor will eventually do something stupid to get his view, and you will have to sue at that time. I would send a certified letter to neighbor denying their request and also asking them nicely, not to "accidentally" do something to destroy the tree.

Should I make a motion to vacate judges decision if my personal injury case was dismissed ? pro per california : My case was dismissed for non-appearance at TSC and OSC . The first one I was there but no one told me it moved to different department . I asked bailiff about my case he said it wasn't on schedule. I received a letter for another court date which I was late for due to uncontrollable circumstances . When I asked bailiff about my case they looked it up and said it was dismissed (w/o) prejudice. F

Do I need to obtain a lawyer to receive surplus funds on foreclosed property?: My property was just sold at foreclosure and as I understand it in California as the owner I am entitled to the remaining funds after the mortgage and fees are paid. Is this a process that I can do myself or am I required to obtain a lawyer for this process.

Michael’s answer: I'll add the following advice. For a lot of people, this process is easy. For the rest, either they mess it up, or a third party puts in a fraudulent claim and they are screwed.

We just had a third party file a fraudulent claim in one of our cases where the surplus funds was $400k+. Our retainer says we get 15% in this case, so I had to litigate a full blown fraud lawsuit for 60k (which is not good). The result was good though, and we are considering a class action now against this particular company.
