What can be done to stop a bully?: What if someone has been mercilessly bullied for over a year, and this person has learned that the bully has done a lot of illegal things to others? Are the police going to help and are they even going to care about these crimes, or is that just how it works in the movies?
Ryan’s answer:
As Mr. Rafter mentioned, there are some things we need to know before any real guidance can be given: is this at work, school, internet, or just someone you know in your daily life? There are limited situations where "bullying" behavior can be a civil lawsuit.
As far as the police, they are usually only going to respond to credible threats of violence against you. They don't usually bother with harassment issues unless it has gotten to physical assault. If you feel threatened you can file for a restraining order or temporary order of protection ("TPO") in the Family Court on Pecos and Bonanza. If you know the person committed crimes and can offer the police specifics, you might call your local LVMPD station and talk to a detective.
How will my case go if my dad defended himself against the k9 with a knife and then he was shot 3 times. ?: My dad called the sheriffs for help. They came saw he had a warrant and tried to arrest him. This is where i dont believe the story..according to the cops he resisted they tazered him but screwed up and he got in his broke down rv and crashed into multiple cops before they forced him to stop.they claim he wouldnt get out of the rv so the sent the dog. In order for the dog to make contact my dad would of had to be coming out of the rv in compliance. The dog attacked him and that wasnt enough for six sheriffs to be able to subdue my 60 yr old disabled dad.and they couldnt tazer him ...why? So they shot him not once or twice but three times. He died at the hospital gunshot to the chest
Ryan’s answer:
Hi there, I'm terribly sorry to hear about the situation with your father. Avvo indicated you asked for me to answer this question.
Unfortunately, it sounds like there are some facts that would make a claim for 42 USC §1983 excessive force difficult: ramming the police vehicles with the RV constitutes assault with a deadly weapon. Further, wielding a knife is a further imminent threat with a deadly weapon. The police are allowed to respond with deadly force to a deadly threat. If your father already rammed a police vehicle, was not subdued by Taser and then canine, and was brandishing a knife, then a federal court would likely find that the police followed escalation of force guidelines and were carrying out their official duties as officers.
What if I'm two days late on my payment plan for tickets?: My ticket is due the 4th which is a Sunday. I get paid on Wednesday which is the 7th. If I pay it on the 7th will I get in trouble with the courts?
Ryan’s answer: There is no grace period for Las Vegas Municipal Court. Las Vegas Township Justice Court will wait several days before issuing a warrant. If it is in LVJC, go online and pay it today, if you have not already.
