How much does it cost to do a motion to convert from ch 7 to ch 13? : i am prose and informa pauperis. my lawyer made a mistake and filed ch 7 now trustee is going after a trust fund i am only a trustee for.

Rodney’s answer: An Attorney that converts your case to a Chapter 13 would be your Attorney of record for your entire case, not just the conversion. As such, he would likely not agree to only charge a fee for the conversion, but rather a fee for the entire case. The conversion would be included in the representation for the entire case.

Question regarding Chapter 7 bankruptcy: I live with my mom and my brother ,and my mom getting SSI income $850 a month. and she has like 15K credit card debt . My brother file his taxes individually and I claim my mom as a dependent, and for last few years I was paying her bills but I can't do it any more . Me and my brother together make 100K a year which is more than median income for household size 3 . I want to know can she still file chapter 7 bankruptcy since she can't pass the means test ?

Rodney’s answer: Based on the information provided, your mother probably qualifies for Chapter 7. Probably her sons’ income does not prevent her from Chapter 7.

Can I get out of this contract/financing if I have yet to take possession of the car?: I signed a contract and put 2000 down on a car on 06-08-2022. While they were trying to get financing they had to use my timeshare address because the bank wouldn't accept my PO box address because I just moved back here. So all docs that I have have my PO box address. I told them to contact me before they pushed the financing through but they did it anyway. Also the car needed recon work which they put that price into the car selling price. When I asked why the price went up they said it was because of taxes but after looking over the paperwork that wasn't the case. They gave me a copy of the recon paperwork later which I hadn't signed but the contract I did. The salesman said that it could take up to 30 days to receive the car but that it usually doesn't take that long. After 33 days I proceeded to call my bank to get my deposit back because I hadn't received the car. They credited it back to me but I still had the financing to deal with. I received a call on 07-20-22 to get the car because it finally is ready which is 3 days before my first payment. They said I can get the car if I give them back the deposit and that they will reimburse me for the first car payment. Just shady
