What happens when you're issued a warrant for your 1st Domestic Battery?: Situation: Me and my girlfriend got into a heated argument where she was continuously hitting me and I pushed her out of the house and locked the door so she called Metro.
Facts: I NEVER hit her but she told the police I broke her phone (never showed proof because it wasn't broken), she stated I had punched her in her leg because she had a bruise from a hiking trip, and she also said I had pushed her out of the house by her neck. They only took pictures of the bruise on her leg because there were no marks elsewhere and she wrote a report stating what I stated above. She went to the hospital because she wanted to check on our unborn baby (she was very upset and hadn't felt the baby kick) when the police came upstairs I didn't answer and didn't go to jail but then Metro issued me a warrant two days ago. I called pretrial services and they put me back on calendar and told me I will have to do a walk through but will my past affect this case? If so what is going to happen? Our baby is due in 7 days
My Past: Convicted of felony with a firearm and convicted of felony trafficking a controlled substance served time and completed parole NEVER had a domestic or any violent charges

Ross’s answer: There is a mandatory 12 hour hold after which you should be released on your own recognizance. Obviously, you have to object to any sat away order the judge may impose. Given your record, the prosecutor will try to pursue the case but there are defense and potential witness issues you need to exploit.

Ross’s answer: Generally, negotiations always contemplate credit for time served so jail should not be an issue unless you pick up another DUI or fail to stay out of trouble during the pendency of the case.
