Accident, personal injury, or other?: I broke my hand at an establishment playing a "boxing" game where you hit a small bag which in turn will tell you your power. With the follow through of my punch I hit the neighboring (directly touching the "boxing" game) wooden speedball cabinet. It caused both a dislocation and two fractures near my thumb. I had to get surgery which is costing me $2500+ after insurance and believe this incident was caused by the poor placement of the speedball game. I have a video of the event, a witness, X-rays, and doctors notes. I also emailed the establishment about the incident and they have not responded to me in over a week.

Is it considered assault if someone says something to anger a person, and that person physically attacks: I told a person that he was being rude, he wanted to take me outside, i told him nothing to fight over. 2 minutes later i was pulled off my seat with him on top of me wailing away. i never threw a punch. The bartender refused to call police, but called the owner, the owner said no police involvement allowed. I left premises and called police. I have yet to be followed up with. Myself and my sister needed hospital evaluation for pretty serious contusions. she was just assisting her husband in pulling the guy off, and he hit her also.

Merely telling someone that they are rude does not appear to embody such.
