If I don't make enough money to sponsor for my fiance's (soon to be husband) papers, can someone else petition for him?: We are getting married soon and I wanted to petition for his green card so he could get his papers sooner than if his family petitioned for him. Do I have to be the one to petition for him or can someone else in the family, or will it take longer?
Solomon’s answer: A petition through a spouse is faster if you are a US citizen. If you do not have enough funds you can get a joint sponsor who could be one of his family members but you must first file the I-864 as the sponsor.
I am a US Citizen. My mother has a green card but has been in India since 2006 - now she wants to come and stay with me.: What are our best options?
Solomon’s answer: Yes she still can. Staying away for more than a year is presumed as abandonment of the green card but it depends on her intent. So at the airport, she will be asked if she knew that the length of her absence from US is an abandonment of the permanent residency. If this is the first time this is happening and she did not know that she was not allowed to stay away that long, she should simply say so. Then the officer will issue her a warning. She will be allowed in but she cannot stay away that long again.
Conditional residency, abusive relationship: I'm a conditional permanent resident until June 2012. My husband is abusive, and every day it's getting worse. I want to file for a divorce. Would I get deported if I ask for a divorce?
Solomon’s answer: No you will not be deported at all. If your card expires in June, it means you should be filing for removing the condition Form I-751 by March which is 3 months before. It is not far from today so i recommend to contact your immigration lawyer right away and I think you should be fine.
