What should if I received a careless driving ticket in Colorado for an accident that wasn't my fault: I was pulling off in Glenwood Colorado to take a break after a long drive and was in a roundabout with 2 lanes in the right lane and then a car hit me from my passenger rear side. When the police arrived I was asked about what happened and I told them multiple times I was in the right lane and was hit from the rear passenger side and then was spun around due to force. The Officers said it didn't make sense to be hit from the rear passenger side in the right lane and then went ahead and gave me a ticket for careless driving and a mandatory court date when the accident wasn't my fault. Though I didn't have all the information right off the bat because I was very shook up because it was my first accident I believe they took the side of the other driver who stated they were in the roundabout as well which wouldn't make sense since I was in the right lane preparing to exit.
Philip’s answer: If you were already fully in the right lane and then within a couple seconds were struck from the right side (not the rear on the right side), you may well wish to contest the charge, and the prosecutor would have to prove otherwise. You may also well need to hire a lawyer to secure your best chance at a dismissal (not me; I'm not selling anything). Best luck.
What would be my penalty for careless driving causing bodily injury?:
I was driving out an intersection and didnt realize I was already out in the middle of the intersection. I tired to go to the opposite side of the intersection and was hit by a car coming to my right. I didn’t see the car coming.
The Officer wrote me careless driving causing bodily injury. The other driver seemed fine at the moment and went to hospital for exam.
I had a clean title and this is my first offend. Will I go to jail for this?
Philip’s answer: You won'r go to jail for a careless driving charge (you can, but you won't), but if convicted you'll pay a fine, have points assessed against you, and insurance consequences. You should at least consult with a lawyer before appearing in court (not me, that would make me a salesman). Best luck.
What is likely to happen with my second meeting with PO to get on UAs or a breathalizer device: I currently Got a dui in arapahoe County colorado.. I spent one night in jail.. got sentenced to 2 years probation classes and drug test (possibly a breathalizer device instead of UAs.. I also got 30 days house arrest but released early for not violating any rules. My probation meeting to set up my breathalizer is in two days and I was wondering if they will UA me right then or if at all
