When we have the child during 1 month out of the year do we have to bring her to the event that the primary conservator schedule: We have my step daughter 1 month out of the year. My boyfriend shares temporary conservator custody with the childs aunt and her husband. She gave us a schedule for the month of july that shows everything that she has planned for the child included soccer practices. She is stating legally we have to bring her to all events they have planned even though we have her during that month. They planned 24 out of the 31 days for stuff she has to do. This gives us no time to have a family vacation or plan anything. Please help. :(
Yexenia’s answer: It all depends on the final decree. At times, decrees will state that the conservator shall make an effort to maintain the child's schedule. Nevertheless, if you are having an issue with the final divorce decree you can always petition the court to modify the orders.
What do I do about Ex-Spouse not following Divorce orders?:
I was divorced 1 year ago, in my Divorces papers, my ex-spouse is responsible for Health Insurance, and has not furnished this. Also, there was to be a life insurance policy with my son as benificiary that has not been designated. Please advise.
Thank you
Yexenia’s answer: You are able to enforce a final divorce decree by filing a motion to enforce. Please note that your former spouse may be held in contempt of court if he does not abide by the decree.
Do I have to notify the non-custodial parent that our child is on medication?:
My divorce decree says I have the independant right to consnet to psychiatric and psychological treatment of the child. Does this mean I can put my son medication for ADHD without his consent?
He has never participated in trying to co-parent and threatens and cusses me out all the time. I have always asked him to be a part but everything is a struggle with him so I opted to take my son to the DR and not tell him until I knew he needed medication. I am the custodial parent and he has normal visitation in the state of Texas.
Basically, I just need to know if I did anything wrong and If I need his permission to medicate my child as the decree is not specific and I can't find anywhere where it says that I should notify the other party.
Yexenia’s answer: I agree with Ms. Laxton, the answer to that question is in your divorce decree. Most divorce decrees provides the non-custodial parent with the right to consult with the doctor's but does not require the custodial parent to obtain permission. However, there are other decrees that do require consultation and agreement with the other parent. It is always best to follow your decree regardless of the other parties' participation.
