My attorney seems to be suffering from dementia what to do?: I retained an attorney for a difficult case. I know there are certain things he should have filed and did not. Plus he missed a very serious hearing on my case. I was able to fix it just because the judge allowed; otherwise I could have lost everything; I called my attorney for entire week and he never returned my calls; now there is another part of my case pending and I know that what he is doing is not necessary; that he just needs to show that all temporary motions in my divorce are dismissed since the divorce was dismissed but he is not doing that. I think he is too old to practice maybe 90. What can I do?
Stephen's answer: Get another opinion on your case from another attorney as soon as possible. Depending on the outcome of that conference you will be in a better position to make decisions regarding discharge of your current attorney, possible fee refund, etc.
Can you add more witnesses after the pretrial?: The Discovery had to be done within 10 days of the pretrial and two days later I received a letter from the other lawyer adding on more witnesses. I thought it all had to be done before the pretrial like the court paper stated. Can he do this?
Stephen's answer: As a general rule in Florida, judges will allow additional witness (assuming the discovery is in good faith) and there is time remaining before trial to allow additional discovery. It is a question of prejudice and the equities involved. There is broad judicial discretion in this regard. However, trial by ambush is typically disfavored. Alot depends on the judge.
