Can a legal immigrant apply for citizenship with a misdemeanor on his record? : My husband came to the US as a child in the late 70's and obtained his green card the day he arrived. I am American and we have been married for 13+ years. He is now in his 50's and is detained every time we come through customs due to a simple assault charge on his record from over 10 years ago. He was ordered to anger management and fines. The CBP officers always ask him, why not become citizenship and avoid this hassle. Well, we have decided to move forward with applying for citizenship. We are in the process of renewing his green card, which will be good for another 10 years. My concern is this issue will interfere with him becoming a citizen. I looked over the application and it seems a little overwhelming.
Mark’s answer: You need to submit a Court Disposition of his case along with your citizenship petition. This record could be obtained by contacting the Clerk of the court where he was brought for trial. During the citizenship interview, be prepared to give a full explanation of what has happened and how he has rehabilitated ever since to the immigration officer.
N-400 current time?:
USCIS processing time indicates that it is taking 11.5 to 15 months to process the application for N-400 in Chicago, IL. In reality how much time is it taking, currently, especially after submission of RFE after the interview in Chicago, IL?
