Robert’s answer: I would agree that the answer to your question is dependent upon a review of the insurance policy, along with the communications you received from the insurance company.

We bought a transmission with a 101. Day warranty from a local company, we paid to have it installed for six hundred. It's bad: Can we make company pay for installation along with extra fluids and parts? We paid 752.00 for transmission with warranty...we then paid 625.00 for installation to another mechanic. We now have to take transmission out and totally redo again with double the cost on us...this just isn't right can you help me or let me know my rights ty

Robert’s answer: Based on your description, the warranty would have to be reviewed to answer the question. There is also a potential issue as to whether the problem you desccribe is related to incorrect installation. I would recommend that you consult with a local attorney to review the language of the warranty and perhaps obtain the opinion of a local mechanic as to the cause of the problem.

Can the HOA charge me for an Structural Engineer inspection of the building, when the repairs are the HOA responsibility?: I bought my townhome one year ago this month and have been fighting with the HOA regarding roof/gutter leaks, siding is no good with mold, cracked foundation, water seeping into the floor heat vents when it rains and over settlement of the back of the building causing my floors to slop, doors & window issues. Last year a company came out and did a free inspection, which they reported back to the HOA that the building has severe damage and they need to send out a Structural Engineer right away. So they hired a SE that did come out and reported back all the issues found last year. The cost for the inspection was paid by the HOA upfront to the SE $2,000, which they are charging back to my account. After almost a year of me following up on the issues and whome responsibility to repair, they finally owned up to the outside foundation cracks that they will repair but still ignoring everything else. However they still have that $2,000 on my account, and I'm still fighting for a justification on how they can charge me for SE inspection that I did not ask for nor is the repairs my responsibility(which still has not been done). The entire building has been neglected for years. Help!!

Robert’s answer: Based upon your description, I am assuming that the inspection was of the entire building, focusing on the exterior, and not specific to your unit. Under these circumstances, your account should not be charged for this inspection. If the HOA is relying upon a specific condo document or rule/regulation, then that would have to be reviewed in relation to your question. Please feel free to contact me to discuss.
