Is the APVP (a form of bath salts) legal or illegal in the state of illinois?: Is the synthetic drug APVP (a form of bath salts) legal or illegal in the state of illinois? or is it still just considered a research drug?

Daniel’s answer: APVP (alpha- Pyrrolidinopentiophenone is a member of the Cathinone class of Stimulants and based upon that probably would be considered a Schedule I Controlled Substance. A-PVP although not specifically named in the Illinois Schedule 1 Enumeration (720 ILCS 570/204) is considered a member of the Cathinone Class which is specifically enumerated as a Class I Controlled Substance (720 ILCS 570/205(f)(5) and last year was specifically added to the DEA's list of Schedule 1 Controlled Substances. It is definitely in your best interest to speak with a knowledgeable attorney within this area of the law. "Bath Salts" are an emerging area of controlled substance law. Hope this helps. Good Luck.

How can i find out if an inactive warrant wants to extradite me without turning myself in.: inactive warrant issued in dupage county illinois 12/2011 , i live in southern illinois now 6 hours from there. they have wanted to extradite me before on a misdemeanor before that was over 5 years old, and this is also a misdemeanor

Daniel’s answer: DuPage Couty is one of the counties that local practicing attorneys do have access to the Clerk's Office records online. These records include digital images of the papers included within the court file. It is a very helpful tool that I use to answer these specific type of questions. The images should also include the warrant, the amount necessary to post, and any geographical limitations on the warrant. A local DuPage County attorney should have access to the exact answers to your questions with a simple phone call and access to a computer.

Officer Made Up Speed for Speeding Ticket?: I just received a speeding ticket for 80 in a 50mph zone. I know for a fact I wasn't going 80 and the officer never said how fast I was going just that he had to go 95mph to catch up to me. On the ticket he didn't check the method he used to clock me either but I know it wasn't radar/laser because I have a detector or pacing because he flew up on my from nowhere like I was standing still and it was weird he made it for more quite a bit faster then my speedometer said I was going. Is it possible to get this ticket dropped in court due to him not actually getting a real reading on my speed? I would just go for court supervision and forget about it but I have a CDL.

Daniel’s answer: Your unlikely to prevail in traffic court against the word of the Police Officer. I would normally recommend to take the Court Supervision and call it a day. However, with a CDL you cant take SUP on a mover or your CDL privileges will be suspended. The normal procedure in these situations is to see if the prosecuting agency will agree to amending the charge to a non-moving violation resulting in no negative effect on your CDL. The most important factor taken into consideration by the prosecuting agency is your driving history. Because of your CDL you would be wise to retain local counsel to assist you in achieving the best possible outcome. Many of us are more than happy to provide a free consultation.
