Is there a way to get rid of my IPS status in MN: I have 3 DWIs on my record only being convicted of 2 never went to court for 1 of them these were all over 20 to 26 years ago

Derek’s answer: Yes, your IPS status can be removed if it has been at least 10 years since any recorded use of alcohol or non-prescribed mood altering drugs. The DMV has a specific form to have the status removed and I don’t believe there is a fee to file it. Keep in mind that due to recent law changes, if you ever get arrested for a new DWI the DMV will look back over your entire lifetime and use those 3 old priors to cancel your license and require you to complete 10 years of driving with the ignition interlock.

I got a dwi in 2007, 2011 and now 2026. Is jail time 100% mandatory in Minnesota?: I’m praying house arrest and work release might be a possibility. I understand that my horrible choices have put me in this place to lose my job, vehicle, roof over my head.

Derek’s answer: The laws in Minnesota regarding “mandatory” jail time are mostly keyed to people who have prior incidents within ten years. That being said, many prosecutors and judges will still be looking for jail time when someone has older prior history. Since the jail time isn’t “mandatory,” it will be important for you to take all the steps you can while your case is pending to put yourself in the best possible light for the prosecutor and the court. It can also make a huge difference if you have an experienced attorney advocating for you and guiding you in the process.
