What will happen: This is my 3rd dui. I got pulled over and blew a .09 the police gave me a PBT test and brought me in to give a urine sample. I didn’t blow at the station. What are my chances of getting a reckless driving or the dui dropped.

Ethan’s answer: I agree with previous response. While you wait for your urine test to come back, you should contact a DWI attorney to discuss options.

First offense to dui. Interlocking device requirements. Time constraints for device requirements: If I have completed an Oregon DUI diversion program, it’s been two years, but I don’t have a vehicle to put on the interlocking breath device. Do I have to wait till I get a vehicle.

Basically my license has been suspended for a year and a half because I haven’t needed it because I don’t have a vehicle. Is there a point where the time without violations will allow me to go get my license back

Only 1st offense dui.

Ethan’s answer: I do agree with previous answer, and wanted to add that you will need to complete 90 days of no negative reports on the IID before the DMV takes off that restriction, regardless of whether you didn't drive during diversion.

How do I defend against duii: The trainer and trainee argued about why I was being arrested. Turn signal not being used or failure to make complete stop. Police never asked for my identification. They placed me in handcuffs and let me fall out of their vehicle twice tearing my rotator cuffs in both shoulders. One threw my own knife at my feet while I was sitting in my car. I asked for a phone call at the jail and trainee yelled at me I didn't deserve a phone call as he was verbally abusing his girlfriend on his personal cell phone inside the jail. I was not given all evidence in a discovery motion.

Ethan’s answer: There is a lot to unpack here and discuss to determine what, if any, issues you might have in your case. You mentioned a discovery motion. Do you have an attorney already? If so, you may want to discuss this with them. If not, I would suggest discussing this matter in more detail with a duii attorney.
