How do I pay charge off amount for auto loan?: I purchased a truck financed through Westlake Financial. I did not make a payment since 2008. It shows up as a charge off on my credit report in 2009. I called Westlake Finance to see which collection agency have my account so that I could settle my debt. They transferred me about three times and had me on hold for about 5 to10 min a transfer; I get a voice mail saying leave a message. I called again but before they transfer me, I asked which collection agency have my account and the representative said that it was still there. How do I negotiate a pay off amount when my account is still in their office? How much should I negotiate after not making a payment for 3 years? What if they do not settle?

Underinsured motorist insurance: My attorney did not file for my $50,000 underinsured motorist insurance with my insurance company even though the cost of my medical care exceeded the minimum insurance coverage of the insured motorist who hit me. He did not make me aware of this until the day we attended mediation with the other driver's insurance company. He told me that he would take care of any additional medical claims but II received a claim from my insurance company that I still owed them $3000 so he did not. What can I do now?

Sam's answer: Well, you need to talk with an attorney to get additional information & to advise you of what your options are. One thing is for sure, you don not want any medical bills going to collection. There are many fine attorneys in Atlanta, including the one's that posted previous to me. I would contact any one of the attorneys that posts an answer to your question to begin the investigative process. I wish you the best of luck & take care. Sam Levine, Esq. www.samlevine.com

Lawyer in Georgia or Ohio?: Due to a period of unemployment, I got behind on my credit card payments and they went into collections. I currently live in Savannah, GA, but I originally got the credit cards while living in Ohio. I am considering hiring an attorney to help with my situation. Do I have to hire an Ohio attorney, or can I hire one in Savannah? The collections companies have discussed my situation with my mother in law and called my parents several times. I believe this is against the law and I want it to stop. I also want to negotiate settlements with the collection companies, preferably with "pay for delete" of negative notations from my credit report. As an educated individual, I could probably negotiate on my own, but I would be willing to pay a lawyer to have it done if that would be more effective.
